These Terms of Service (“Terms”) govern your use of the Desk to Bikini® app (“App”) operated by Desk to Bikini LLC (“we,” “our,” or “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who We Are

Desk to Bikini LLC is a company founded by Philita Jana that provides the Desk to Bikini® fitness app. You can reach us at info@desktobikini.com.

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you confirm that you meet this requirement. The App is intended for adults, and subscription purchases require you to be at least 18 years old or have parental consent.

3. Subscriptions and Billing

Full access to the App requires a paid subscription or a one-time lifetime purchase, offered through Apple In-App Purchase. The following plans are available:

  • Monthly — $9.99/month: Includes a 7-day free trial. Auto-renews monthly until cancelled.
  • Annual — $59.99/year: Includes a 7-day free trial. Auto-renews annually until cancelled.
  • Lifetime — $149.99 (one-time): Single payment, no recurring charges, permanent access.

Free trial: Monthly and Annual plans include a 7-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged automatically.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours before the renewal date.

Cancellation: You can cancel your subscription at any time through your Apple ID account settings (Settings › Apple ID › Subscriptions). Cancellation takes effect at the end of the current billing period, you retain access until then. We do not offer refunds for unused portions of a subscription period, except where required by applicable law.

Price changes: We may change subscription prices at any time. We will notify you of price changes before they take effect. Continued use of the App after a price change constitutes acceptance of the new price.

All billing and payment processing is handled by Apple. We do not store your payment card details. For billing disputes, contact Apple Support.

4. Health and Fitness Disclaimer

The Desk to Bikini® App provides general fitness information and AI-generated workout programs for educational and motivational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Before starting any exercise program, consult your doctor or a qualified healthcare provider, especially if you have any pre-existing medical conditions, injuries, or health concerns. Stop exercising immediately and seek medical attention if you experience chest pain, shortness of breath, dizziness, or unusual discomfort.

You assume full responsibility for any risks associated with your use of the App and participation in the workouts. Desk to Bikini LLC is not liable for any injury, illness, or damage resulting from your use of the App or reliance on its content.

5. AI-Generated Content

Your workout programs and coach check-in messages are generated by artificial intelligence (OpenAI GPT-4o) based on the information you provide during onboarding. AI-generated content is provided as a starting point and general guide, not as personalised medical or professional fitness advice.

AI-generated programs may not be suitable for every individual. We recommend adapting workouts to your actual fitness level and stopping any exercise that causes pain or discomfort. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to reverse engineer, decompile, or tamper with the App
  • Use automated tools or scripts to make excessive requests to our servers
  • Share, resell, or redistribute App content without our written permission
  • Attempt to access other users’ data or circumvent any security measures
  • Submit false or misleading information through the support form

We reserve the right to suspend or terminate access to the App if you violate these Terms.

7. Intellectual Property

All content in the App, including but not limited to the Desk to Bikini® name and trademark, exercise library, written content, design, and workout methodology, is owned by Desk to Bikini LLC or licensed to us. Nothing in these Terms grants you any right to use our intellectual property for commercial purposes.

Your AI-generated workout program is created for your personal use. You may not reproduce or distribute it for commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by law, Desk to Bikini LLC and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of revenue, arising from your use of the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Governing Law

These Terms are governed by the laws of the United States and the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to These Terms

We may update these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
